Your privacy is very important to Hot 8 Yoga, LLC (“Hot 8 Yoga,” “we,” “us,” and “our”). We also understand that privacy is very important to you. This Privacy Notice describes how we collect, protect, and use any information we collect from or about our students, ecommerce customers, on-demand users, and website visitors, and your ability to control certain uses of it. It does not apply to employees or job applicants. Within this Privacy Notice, we refer to attending a Hot 8 Yoga class or event (live, online, or recorded), using our on-demand offerings (see also Vimeo’s privacy policy here), visiting our website, making a purchase on our ecommerce site, or otherwise interacting with Hot 8 Yoga collectively as engaging in Hot 8 Yoga “Activities.”

This Notice applies to the information we collect from or about you when you participate in Activities, or otherwise interact with us.  It does not apply to information we collect from employees or job applicants of Hot 8 Yoga.  When we use the term “personal information” in this Privacy Notice, we mean information that identifies, relates to, describes, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a particular individual or household. This includes information such as, for example, your name, address and device information that can reasonably be linked to you or your household, such as your IP address. INFORMATION WE COLLECT  

We collect information from you when you provide it to us, from third party sources, including social media platforms, and from you automatically when you participate in the Activities.  

Information You Provide.  

Hot 8 Yoga collects information you provide to us when you participate in the Activities. For example, we collect the information you provide when you create an account, complete a questionnaire, communicate with us, sign up for or attend an event, take a class in person or through our on-demand platform, view a recording through our on-demand Vimeo platform, purchase products from our website on our eCommerce site, fill out a webform or otherwise interact with this us.  The personal information we collect from you directly when you provide it to us, when you interact with us, or when you visit our Site, may include the following:  

  • Contact information, including your name and/or nickname, email address, mailing or delivery address and phone number 
  • Order information, including the products you purchase or services you request from us, and your shopping behavior and preferences  
  • Payment information, including billing address and payment method, in order to facilitate payments to us and keep a record of payments we receive. Payments are processed by our third-party payment processor, and we do not collect credit card or financial account information from you 
  • Sensory information through our on-premises surveillance cameras used in the retail area and front-desk area of our studios 
  • Credential information for eCommerce customers who create an account within Shopify, including your username and password 
  • Information about your interests, such as your buying habits based on previous purchases 
  • Information about your preferences, such as whether you prefer teacher assists in class, or prefer to not have teacher assists 
  • Your correspondence with us, if you reach out to us for customer service or technical support, or apply for Hot 8 Yoga’s BIPOC scholarship 
  • Information about your race, ethnicity or other characteristic that you choose to share with us as part of our BIPOC scholarship, if you apply for the scholarship 
  • Any other information you voluntarily provide to us, including information about any health or medical conditions you may have that you disclose to us as part of your yoga practice or when you are freezing or canceling your membership 
Information We Collect from Third-Party Sources, Including Social Media Platforms.  

We may collect information about you from third party sources. This includes third party booking platforms that you book a Hot 8 Yoga class through, such as ClassPass and GymPass, which provide us with your name, contact information, and any applicable consent form you sign when you agree to take one of our classes. We also collect information from Vimeo OTT, which powers our Hot 8 Yoga On-Demand offering, including your name, contact information, subscription status, transactions, and marketing analytics, or which provide you connect to Hot 8 Yoga on Demand through (for example, Roku, Amazon Fire TV, tvOS, or Android TV). Our website, mobile app, or online services offerings also may allow you to register with, log on to, or enhance the profile you create on our website by choosing to automatically populate the requested data fields with information you previously provided to a third-party social media platform (such as Facebook, Instagram, or Twitter), or to a third party eCommerce platform such as Shopify. By doing this, you are giving permission for the third-party platform to send us information and for us to collect that information from them, including personal information from your profile on that platform such as your name, email address, and social media user ID, among other information.  

Information We Collect Automatically from your Browser or Device. 

Hot 8 Yoga collects information that is sent to us automatically by your web browser or mobile device. We may use cookies, pixel tags, clear GIFs, and similar technologies to collect this information from you. For more information about how we use cookies and similar technologies to collect information from you, please visit our Cookie Policy. The information we collect from you automatically typically includes your IP address, the name of your operating system, the name and version of your browser, the date and time of your visit, and the pages you visit. The information we receive may depend on your browser or device settings. Generally, we use this information in the aggregate to help us improve our website and make it more compatible with the technology used by our visitors. We also use it to monitor traffic, including usual activity, on our website, mobile app and online services to promote and increase our information security efforts. We may also take personal information we have collected and de-identify it or compile it so that it is aggregated and no longer personally identifiable in nature.

  • With Service Providers, Vendors, and Consultants. Hot 8 Yoga shares information we collect with third-party service providers, vendors, and consultants who act for us or on our behalf. We use third-party vendors to help us perform business, professional, and technical support functions for us, including to help us design and operate our website, mobile app and online services, conduct surveys, to help us with our marketing and promotional efforts, and to provide us with software, services, and platforms that we use to operate our business, among other reasons.  
  • To Hot 8 Yoga Employees and Teachers. The information we collect from our about you will be disclosed or accessible to Hot 8 Yoga employees, including instructors of our classes, studio employees and corporate employees.  
  • Through Technologies Used on our Website. We use certain technologies on our website to offer our products and services. These may technologies include cookies, pixels, and clear GIFs (described further below), and session replay technology. Some of these technologies are provided by third parties, or allow third parties to access your information, including your viewing habits and viewing history (in the case of videos posted on our website, or on-demand offerings), browsing habits and browsing history, and other information about your visit to our website, mobile app, or use of our service offerings, including our on-demand platform.  
  • With Third Party Partners. We may share your information with other organizations who partner with Hot 8 Yoga on certain initiatives. For example, from time to time, we partner with other health or wellness initiatives to co-sponsor an event. At these co-sponsored events, your information may be shared with all sponsors. We may also partner with third parties to sponsor contests or other promotions, and we may share with these third parties the information you submit to us to participate in the contest or take advantage of the promotion. 
  • To Third Parties for Our Marketing Purposes. We disclose information to third parties who assist us in our marketing efforts by developing target audience creation tools based on information we provide to them about our existing target customers. 
  • To Third Parties for Their Own Marketing Purposes. We may share your information with third parties for their own marketing purposes, including with third parties that we partner with, as described above. Information we collect automatically through third-party pixels, cookies, and similar technology may also assist both us, and other organizations, with analytics and marketing efforts.  
  • In aggregate or de-identified form. We use information collected through this Site to create a compiled, aggregate view of usage patterns. We may share aggregate information with third parties so they can better understand our user base. We may also share with third parties information about how particular individuals use our website, mobile app, and online service offerings, but only on a de-identified basis. This de-identified data reflects the usage patterns of a particular website, mobile app, or online services user, as opposed to users collectively.

A NOTE ABOUT CHILDREN’S PRIVACY

Hot 8 Yoga is a U.S. corporation. The servers that support this Site are located in the United States. EGIFTS AND REFERRALS

Hot 8 Yoga occasionally administers giveaways, surveys, and sweepstakes, and offers a discount to individuals who sign up to receive marketing emails (together, the “Programs”). From time to time, we may offer free products, coupons or other price reductions for our products and services in exchange for your voluntary participation in these Programs. We offer these Programs to enhance our relationship with you so that you can enjoy more of our products and services at a lower price.  When you participate in any of these Programs, you agree to allow Hot 8 Yoga and its Program-related service providers to: (i) collect personal information and information about your purchases and interactions with Hot 8 Yoga; (ii) use the information as outlined in this section and in our Privacy Notice; and (iii) share the information with our service providers, affiliates, and third parties as identified and described in Hot 8 Yoga’s Privacy Notice. Information Automatically Collected 

Hot 8 Yoga automatically collects information about employees when you use Hot 8 Yoga’s equipment and services. For example, all Hot 8 Yoga owned devices have certain security measures that scan and monitor your device (and collect information from your device) to alert us to potential cybersecurity attacks on your device. We also scan your device, including your Hot 8 Yoga email account, to determine whether any sensitive or protected information is leaving the company, such as trade secrets and other proprietary or sensitive business information. We also have physical surveillance, such as video cameras, on most of our premises to allow us to physically monitor our premises. As an employee who works on our premises, these video cameras automatically collect on an ongoing basis information about individuals who are on our premises, and accordingly, we may also collect sensory and other audio visual information from or about you when you are on our premises.  

Information Collected from Other Sources 

We may obtain information about you from other sources, including from publicly available sources and databases, and third parties such as recruiters, benefits providers, and other employees or references who provide feedback about your performance. The information we collect from other sources may include information about your current or past job performance, credential and education information, and background and credit check information, among other types of information.  

Combination of Information 

We may combine the personal information you provide to us with information from and about you that we automatically collect or that we receive from third parties. For example, we might add information to your employment file that we receive from your supervisor, or from a third-party recruiter if you apply for a job with our company through a recruiter. We do not combine information we receive from you as a visitor to our studios, participant in our classes, website visitor, or outside of your capacity as an employee or job applicant with information we receive from you as an employee or job applicant.

Non-Personal Information 

We may collect and use information that is not personally identifiable, such as information that is aggregated, de-identified, or otherwise not personal in nature. We may also take personal information we have collected and de-identify it or compile it so that it is aggregated and no longer personally identifiable in nature. For example, we may aggregate information about employees or job applicants by age range, gender, or race and ethnicity to understand and promote equity and inclusion among our workforce.

DATA SECURITY 

Hot 8 Yoga understands the importance of data security. We use reasonable and appropriate physical, administrative, and technical measures to safeguard the information we collect from and about you. While we make every effort to help ensure the integrity and security of our network and systems, we cannot guarantee the absolute security of our security measures. 

DATA RETENTION 

Hot 8 Yoga will only retain your personal information for as long as reasonably necessary to fulfill the purpose for which the information was collected, in accordance with applicable laws and Hot 8 Yoga’s data retention policies and practices.
